The proposed draft grants executive council members, the office of the High Representative, and forces participating in reconstruction operations full exemption from appearing before local Gaza courts. Under these provisions, the council's chairman, Donald Trump, holds exclusive authority to lift immunity from any individual, provided he obtains the approval of the majority of the seven executive council members.
The executive council includes prominent figures in Trump's inner circle, among them his son-in-law Jared Kushner, special envoy Steve Witkoff, as well as White House Chief of Staff Susie Wiles and National Security Advisor Marco Rubio. This composition reflects the US administration's desire to tighten its political and security grip on the Gaza management file in the post-war phase.
In addition to legal immunity, the document included a clause allowing the council and its international forces to obtain buildings and public facilities within the Gaza Strip for free and without any costs. Legal experts warned that this text could legitimize the seizure of public or private Palestinian property without the consent of its owners or the provision of fair compensation, in the absence of a legal framework regulating the work of these forces.
In the context of field movements, sources reported that the council's High Representative, Bulgarian diplomat Nikolay Mladenov, is holding a series of meetings in the Egyptian capital, Cairo. These meetings with Palestinian officials chosen by the council aim to complete the regulatory and logistical frameworks for starting actual work within the Strip, although the immunity project has not yet been presented to the Palestinian side.
These leaks sparked a wave of criticism among international law experts, with lawyer Emily Schaeffer Omer-Man considering the document a clear attempt to evade responsibility for any violations that may occur. She believed that the absence of accountability could lead to disasters in the event of shooting incidents or civilian deaths during the implementation of reconstruction projects.
For his part, an official in the Peace Council denied the authenticity of the leaked document, describing the information contained therein as 'misleading and inaccurate.' The official affirmed that the council plans to ensure that all personnel are subject to applicable laws and to establish clear mechanisms for oversight and accountability, but he did not provide specific details about the nature of these mechanisms or the bodies that would oversee them.
The council's plans, according to participating contractors, indicate an intention to build a military base for international forces and major logistical centers in strategic areas of the Strip. The primary mission of these forces will be to support the disarmament process of Palestinian factions, which Trump's plan considers a fundamental pillar for ensuring future stability in the region.
Observers believe that this document reflects a tendency to impose a de facto authority in Gaza that transcends international laws and established diplomatic norms.
