ICJ: The continued presence of "Israel" in the Palestinian territories is illegal and must be ended as soon as possible
The International Court of Justice said on Friday that it can give a non-binding advisory opinion on Israel's occupation of Palestinian territories, rejecting calls from Israel and a group of other countries to not agree to give the opinion.
The court said that Israel's settlement policies and exploitation of natural resources in the Palestinian territories are a violation of international law. The court said it was “not convinced” that expanding Israeli law to include the West Bank and East Jerusalem was justified.
The court considered that the deportation of the residents of the occupied territories from their lands was “forced,” which violates Israel’s obligations.
It also considered that Israel’s practices and policies violate the Palestinians’ right to self-determination, and that the systematic system of restrictions imposed by Israel on the Palestinians is considered “discrimination based on race.”
The court said that Israel's policies and practices in the Palestinian territories amount to the illegal annexation of large parts of those lands.
It concluded that Israel systematically discriminates against Palestinians in the occupied territories.
According to the court, Israel must compensate the Palestinians for the results of its illegal practices. The court also recognized that Israel must end its occupation as soon as possible.
Israeli Minister of National Security Itamar Ben Gvir considered that “the decision of the International Court of Justice proves that it is anti-Semitic, and we will not accept sermons from it.”
