Federal Judge Thomas Hardiman, of the US Court of Appeals, issued a decision allowing Palestinian activist Mahmoud Khalil to remain outside detention centers on a temporary basis. This judicial move comes as Khalil continues his legal efforts to challenge the Trump administration's actions before the Supreme Court, granting him an additional opportunity to pursue his legal case without the constraints of immediate detention.
Judge Hardiman's decision, who was appointed during the tenure of former President George W. Bush, included a stay of execution of a previous ruling by the Court of Appeals that aimed to transfer Khalil's case to the jurisdiction of immigration courts. This judicial intervention followed a legal opinion issued last Friday questioning the authority of federal court judges in New Jersey to make decisions regarding release or prevention of deportation in such cases.
The roots of the case date back to last year, when US immigration authorities arrested Mahmoud Khalil while he was pursuing his postgraduate studies at the prestigious Columbia University. The arrest came against the backdrop of his involvement in student activism and protests that swept American universities condemning the ongoing Israeli war of extermination in the Gaza Strip since 2024, which sparked widespread debate about freedom of expression.
For his part, US Secretary of State Marco Rubio entered the crisis, considering Khalil a direct threat to US national security, despite his status as a permanent resident in the country. These statements reflect the intensity of the political stance towards Palestinian activists and human rights defenders who face strict administrative and legal measures under the current administration.
It is worth noting that Federal Judge Michael Farbiarz had ordered Khalil's release last June after he spent more than a hundred days behind bars in harsh detention conditions. Farbiarz at the time described the steps taken by federal authorities as lacking constitutional cover, emphasizing the activist's right to freedom pending the completion of the legal procedures in his case.
