An American court rejects a lawsuit against the Biden administration for supporting Israel in the Gaza war
Yesterday, Monday, a federal appeals court rejected a lawsuit filed by Palestinian human rights activists who accused the administration of US President Joe Biden of complicity in genocide in Gaza by continuing to provide military, diplomatic and financial support to Israel.
A three-judge panel of the Ninth Circuit Court of Appeals in San Francisco upheld the decision to dismiss the case, noting that the case raises political questions related to foreign affairs, which are issues that the court cannot decide.
"Plaintiffs' lawsuit and their extraordinary requests for relief raise political questions grounded in issues within the jurisdiction of the branches of our government that have military and diplomatic powers," she wrote.
Two Palestinian rights groups, Defense for Children International-Palestine and Al-Haq, along with many Gazans and Palestinian-Americans, said the United States was violating its obligations to prevent genocide.
Last November, plaintiffs filed a lawsuit against President Biden, Secretary of State Antony Blinken, and Defense Secretary Lloyd Austin, protesting continued support for Israel that they viewed as a violation of international law and the 1948 Genocide Convention.
Last January, US District Court Judge Jeffrey White reluctantly dismissed the lawsuit, saying that “the court cannot reach the preferred result,” citing evidence that he said showed that “the ongoing Israeli military siege in Gaza aims to eliminate an entire people.” “It therefore falls within the international prohibition of genocide.”
Under the so-called political questions doctrine, White concluded that the plaintiffs' claims could not be heard in court, because they raised a foreign policy dispute that the legislative and executive branches should consider.
Since the start of the aggression on Gaza, the United States has provided Israel with strong military, intelligence, and diplomatic support, and is scheduled to supply it with weapons worth billions of dollars in the coming months.
The Israeli newspaper Maariv revealed that the bombs, which the army used a few days ago to bomb the displaced persons’ camp in Khan Yunis, south of Gaza, are of the advanced and deadly JDEM model, American-made, and are laser-guided and rely on advanced sensor technology and artificial intelligence.
This massacre - which took place in Al-Mawasi camp - resulted in the death of about 90 Palestinians, half of them children and women, and hundreds of injuries, including serious injuries, according to the Ministry of Health in Gaza.
It is also likely that American-made Mk 84 bombs were dropped by Israel on civilians in the Al-Baptadi Hospital and Jabalia Camp massacres, during its war on the Gaza Strip in October 2023.

During the 284 days of the aggression on Gaza, the occupation forces committed more than 3,390 massacres, resulting in the martyrdom of more than 38,000 Palestinians, including 16,000 children and about 11,000 women, as well as the injury of 88,000 others.
The occupation forces also dropped more than 80,000 tons of explosives on the Strip, during which they completely destroyed 150,000 residential units, and more than 200,000 partially, and put 34 hospitals out of service.
The occupation continues its aggression on land, sea and air, ignoring the UN Security Council resolutions to stop it immediately, and the orders of the International Court of Justice to take measures to prevent acts of genocide and improve the miserable humanitarian situation in Gaza.
Israel is defying the request of International Criminal Court Prosecutor Karim Khan to issue arrest warrants against its Prime Minister Benjamin Netanyahu and Defense Minister Yoav Galant for their responsibility for “war crimes” and “crimes against humanity” in Gaza.
For the 18th year, the Israeli occupation has besieged Gaza, and its war has forced about two million of its residents - numbering about 2.3 million Palestinians - to be displaced in catastrophic conditions, with severe scarcity of food, water and medicine.
Since October 7, 2023, Israel, with American support, has been waging a devastating war on Gaza, which has left nearly 127,000 Palestinian martyrs and wounded, most of them children and women, and more than 10,000 missing, amid massive destruction and famine that has claimed the lives of dozens of children.
